Judge denies new trial to Barry Beach in 1979 beating death

HELENA - A District Court judge in Wolf Point has denied Barry Beach's request for a new trial in a 1979 murder.

Beach was convicted of the beating death of 17-year-old Kim Nees on the Fort Peck Reservation and is serving a 100-year prison term.

District Judge David Cybulski on Monday said the evidence offered by Beach does not prove he is innocent of the crime.

Beach has argued that his confession was coerced.

He also argued that testimony from others connects a group of girls' to Nees' murder. However, the state Board of Pardons and Parole called that testimony as double and triple hearsay in rejecting his petition for executive clemency last year.
