Butte jury awards $500K to estate of woman who died after falling on sidewalk

BUTTE - A District Court jury in Butte has awarded more than $500,000 to the estate of an 86-year-old woman who died after falling on a public sidewalk.

Mina Comer fell April 26, 2006, while walking on Harrison Avenue. She died 12 days later.

Mary and Paul Sims sued Butte-Silver Bow and the state of Montana in 2007.

Paul Sims was Comer’s son-in-law. He and his wife are representatives of the woman’s estate.

The lawsuit contended the city-county and state were negligent in maintaining the sidewalk.

The state is responsible for paying $377,898 of the settlement.

Butte-Silver Bow is responsible for paying $174,414.

Both the state and city-county denied they were negligent, and they dispute who was responsible for maintaining the sidewalk.

The state has filed suit on that issue against Butte-Silver Bow.
