Watch a video of Cody von Appen's court hearing.Cody von Appen, one of three Grizzly football players allegedly involved in a Sept. 19 assault that left a University of Montana student with a broken jaw, was arrested Monday for violating terms of his release by allegedly assaulting a second student.
Von Appen, 18, is being held in the Missoula County jail on $10,000 bond because of the Nov. 2 incident.
At Monday afternoon's hearing, Deschamps prohibited von Appen from contacting his co-defendants or witnesses.
“It sounds like they're sort of like a pack of dogs,” Deschamps said. “One of them is fine, but you get two or three of them and there's trouble.”
Deschamps also barred von Appen from the UM campus.
Deputy County Attorney Jason Marks said the victim of the Sept. 19 assault had encountered von Appen on campus numerous times. The encounters made the victim “very uncomfortable,” Marks said.
Three freshman redshirt football players - von Appen, Andrew Douglass and Justin Montelius - were charged with felonies following the September assault, which was captured on a dormitory surveillance camera.
The 18-year-old victim was knocked unconscious, suffered several cracked and chipped teeth and a broken jaw, according to charging documents.
Last week, Douglass and von Appen withdrew from the University of Montana, and Douglass asked to be allowed to move back to California with his parents, according to court documents.
Montelius is still enrolled at UM, said Charles Couture, UM dean of students. On Monday, Deschamps scheduled Montelius' trial for March.
Montelius is a Missoula resident and graduate of Big Sky High School.
The most recent assault allegedly occurred outside a UM fraternity on Nov. 2. Douglass was allegedly with von Appen at the time, but did not participate in the second assault, according to Marks.
Tim Browne, 21, the alleged victim in the most recent assault, did not press charges with police.
“I decided not to (press charges) because I feel bad for the kid, to be honest,” he said.
Browne suffered a cut lip that required stitches, he said.
Marks said that because charges were not filed, the county was not able to arrest von Appen until Monday's hearing, which was the first convenient opportunity to bring him before a judge. Von Appen was arrested on the basis of a police investigation.
There was no need to expedite von Appen's arrest, Marks said, as he did not think von Appen would re-offend before the hearing based on the circumstances of the incident. Marks said he could not elaborate on those circumstances.

" I personally feel that Von Appen's bail is too low for this sort of criminal activity and bail should be higher than the 10K listed. Also, he needs to be put on electronic "hack" (house arrest), til the court can decide on a much more stiffer penalty. Enough is enough. Make Von Appen pay for this. "
